TERMS OF SERVICE

OVERVIEW

This website, reaperrags.com, is operated by ReaperRags ("ReaperRags", "we", "us", "our"). By visiting the site, creating an account, subscribing to our communications, or placing an order, you agree to these Terms of Service ("Terms"), our Refund Policy, our Shipping Policy, and our Privacy Policy, all of which are incorporated here by reference. If you do not agree, do not use the site.

We may update these Terms at any time by posting the revised version here. Continued use of the site after changes are posted means you accept them. Our store is hosted by Shopify Inc.

ELIGIBILITY

You must be at least the age of majority in your state or country of residence to purchase from us. By placing an order, you confirm that you meet this requirement and that all information you provide is accurate and complete.

PRODUCTS

Vintage. Every vintage piece we sell is hand sourced, authenticated, washed, and inspected before it is listed. Vintage pieces are original garments from their era, are one of one, and show signs of age and wear consistent with their condition as photographed and described. Measurements are listed on each product page and are taken from the garment itself, not the tag. You are responsible for reviewing photos, measurements, and descriptions before purchasing.

HELLVEX. HELLVEX is the original line designed and produced by ReaperRags. HELLVEX pieces are new, premade, and produced in limited runs and limited sizes. Size guides are listed on each product page. We do not guarantee restocks of any HELLVEX piece or size.

Brand names. ReaperRags is an independent reseller of authenticated vintage garments. The brand names, logos, and trademarks appearing on vintage pieces belong to their respective owners. ReaperRags is not affiliated with, endorsed by, or sponsored by any of these brands. Vintage listings identify the original maker of the garment for accuracy only.

Images. We photograph every piece ourselves and work to display color and condition as accurately as possible. We cannot guarantee that your screen reproduces color exactly.

We reserve the right to limit quantities, to refuse or cancel any order, to discontinue any product, and to restrict sales to any person, region, or jurisdiction at any time.

DROPS AND AVAILABILITY

Vintage drops go live every Friday at 8:30 PM Central Time. All pieces are first come, first served. Adding an item to your cart does not reserve it. An item is yours only when your payment has been completed and you have received an order confirmation. If two customers attempt to purchase the same one of one piece, the first completed payment wins and the other order will be cancelled and refunded in full.

We do not hold, reserve, or pre sell pieces. Early access is offered at our discretion to email and SMS subscribers and may be changed or withdrawn at any time.

The use of bots, scripts, automated checkout tools, multiple accounts, or any other method to gain an unfair advantage during a drop is prohibited. We may cancel orders and block accounts that we believe have used such methods.

PRICING AND ERRORS

All prices are in US dollars unless otherwise displayed. Prices, availability, and product information are subject to change without notice. Despite our best efforts, the site may occasionally contain errors in pricing, descriptions, or availability. We reserve the right to correct any error, to cancel any order affected by an error, and to refund any payment made on it, including after an order confirmation has been sent.

ORDERS AND PAYMENT

By placing an order you make an offer to purchase. Your order is accepted when it ships. We reserve the right to cancel any order before shipment for any reason, including suspected fraud, resale, policy abuse, or product unavailability, and will issue a full refund if we do.

You agree to provide current, complete, and accurate billing, shipping, and contact information, and to keep it updated so we can complete your order and reach you if needed. We are not responsible for orders shipped to an incorrect address supplied by you.

Orders cannot be changed or cancelled once placed. See our Refund Policy.

DISCOUNT CODES

Discount codes are valid only for the products, collections, dates, and customers stated at the time they are issued. Unless otherwise stated, only one code may be used per order, codes cannot be applied to previous orders, and codes cannot be combined with other offers. We may cancel orders that use codes obtained through unauthorized sharing, leaked code sites, or in violation of the code's terms.

SHIPPING

Orders ship within 48 hours of purchase, excluding weekends and holidays. Shipping rates, delivery estimates, tracking, address requirements, and our handling of returned packages are set out in our Shipping Policy. Delivery estimates are not guarantees. Risk of loss passes to you when the carrier marks the order as delivered.

INTERNATIONAL ORDERS

We ship worldwide. International orders may be subject to import duties, taxes, and fees set by the destination country. Where these are collected at checkout, no further charges will apply on delivery. Where they are not collected at checkout, they are your responsibility and must be paid on delivery. Refused or unclaimed international packages are handled under our Refund Policy and any duties, taxes, or return costs incurred will be deducted from any refund.

RETURNS AND REFUNDS

All sales are final. Our full Refund Policy, including the process for damaged or incorrect items, is incorporated into these Terms.

CHARGEBACKS

By purchasing from us you agree to contact services@reaperrags.com and give us a reasonable opportunity to resolve any issue before opening a dispute or chargeback with your bank or payment provider. We contest chargebacks on orders that were delivered as tracked or that fall under our final sale terms, and we provide full documentation including order records, policy acceptance, tracking, and delivery confirmation. Accounts associated with abusive or fraudulent chargebacks will be blocked from future purchases.

INTELLECTUAL PROPERTY

REAPERRAGS® is a registered trademark of ReaperRags with the United States Patent and Trademark Office. HELLVEX, the HELLVEX logo, and all other names, logos, and marks used on this site are trademarks of ReaperRags. Unauthorized use of any of these marks, including on garments, in listings, in store or account names, or in advertising, is prohibited and will be enforced.

All HELLVEX designs, prints, embroidery, product names, collection names, photographs, videos, copy, and site content are the property of ReaperRags and are protected by copyright, trademark, and other applicable laws. You may not copy, reproduce, distribute, modify, create derivative works from, or commercially exploit any of it without our written permission. This includes reproducing HELLVEX designs on other garments, reselling counterfeit or unauthorized reproductions, and using our product photography in your own listings on any platform.

Nothing on this site grants you any license or right to use our marks or content. We reserve all rights.

REVIEWS AND USER CONTENT

If you submit a review, comment, photo, video, or other content to us or tag us on social media, you grant ReaperRags a perpetual, worldwide, royalty free license to use, reproduce, edit, publish, and display that content in any medium for marketing and operational purposes, with no obligation to compensate you or keep it confidential. You confirm that your content is your own, is accurate, does not violate the rights of any third party, and is not unlawful, abusive, or misleading. We may remove any content at our discretion.

CREATOR PROGRAM

Participation in the ReaperRags creator and affiliate program is subject to the separate terms provided at the time of application and through Shopify Collabs. Commission rates, attribution windows, and audience discounts are set by us and may be changed at any time.

PROHIBITED USES

You may not use the site or its content for any unlawful purpose, to violate any law or regulation, to infringe the rights of others, to harass or harm anyone, to submit false or misleading information, to upload malicious code, to scrape, crawl, or collect data, to interfere with the site's security or operation, or to circumvent any purchase limit or drop mechanic. We may terminate your access for any violation.

THIRD PARTY LINKS AND TOOLS

The site may contain links to or tools from third parties, including payment providers, tracking services, and social media platforms. We do not control and are not responsible for their content, availability, or practices. Your use of them is at your own risk and subject to their terms.

DISCLAIMER OF WARRANTIES

The site, its content, and all products are provided as is and as available. To the fullest extent permitted by law, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, and non infringement. We do not warrant that the site will be uninterrupted, timely, secure, or error free, or that any product will meet your expectations. Vintage garments are sold with the condition characteristics disclosed in their listing and no further warranty is given.

LIMITATION OF LIABILITY

To the fullest extent permitted by law, ReaperRags and its owner will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, revenue, data, or goodwill, arising from your use of the site or any product, including carrier delays, carrier loss or damage, sizing or condition dissatisfaction, or errors on the site. Our total liability for any claim relating to an order will not exceed the amount you paid for that order. Where the law does not allow these limitations, our liability is limited to the maximum extent it permits.

INDEMNIFICATION

You agree to indemnify, defend, and hold harmless ReaperRags and its owner from any claim, demand, loss, or expense, including reasonable legal fees, arising from your breach of these Terms, your violation of any law, or your violation of the rights of any third party.

GOVERNING LAW AND DISPUTES

These Terms and any dispute arising from your use of the site or purchase of our products are governed by the laws of the State of Ohio and the United States, without regard to conflict of law principles. You agree that any legal action will be brought exclusively in the state or federal courts located in Ohio, and you consent to their jurisdiction. Before filing any claim, you agree to first contact us at services@reaperrags.com and attempt to resolve the matter in good faith.

SEVERABILITY, WAIVER, AND ENTIRE AGREEMENT

If any provision of these Terms is found unenforceable, the remaining provisions remain in full effect. Our failure to enforce any provision is not a waiver of it. These Terms, together with the policies incorporated above, are the entire agreement between you and ReaperRags and replace any prior agreements or communications.

TERMINATION

These Terms remain in effect until terminated. We may suspend or terminate your access to the site at any time, without notice, if we believe you have violated these Terms. The provisions that by their nature should survive termination, including intellectual property, limitation of liability, indemnification, and governing law, will survive.

SMS TERMS OF SERVICE

The ReaperRags mobile message service (the "Service") is operated by ReaperRags. By opting in to receive text messages from us, you agree to these SMS Terms in addition to the Terms of Service above and our Privacy Policy.

Consent. By providing your mobile number at checkout, through a signup form or popup, by texting a keyword to us, or by any other opt in method, you consent to receive recurring automated marketing and transactional text messages from ReaperRags at that number, including messages sent using an automatic telephone dialing system or similar technology. This applies even if your number is on a state or federal Do Not Call list. Marketing messages may include drop alerts, launches, early access, promotions, cart reminders, and brand updates. Transactional messages may include order confirmations, shipping updates, and account notices.

Consent is not a condition of purchase. You can buy from ReaperRags without subscribing to text messages.

Frequency and cost. Message frequency varies. We do not charge for the Service, but message and data rates may apply according to your wireless plan. Check with your carrier for details.

Opting out. Text STOP to +1 855 703 4617 or use the unsubscribe link in any message to cancel at any time. You will receive a one time confirmation text and no further messages unless you opt back in. If you are subscribed to more than one ReaperRags messaging program, you must opt out of each separately.

Help. Text HELP to +1 855 703 4617 or email services@reaperrags.com.

Your number. You agree to provide a valid mobile number that you own. If you change or cancel your number, you are responsible for opting out and re subscribing with your new number. We may change the number or short code used to operate the Service and will notify you if we do.

Carriers. Wireless carriers are not liable for delayed or undelivered messages.

Liability. To the extent permitted by law, ReaperRags is not liable for failed, delayed, or misdirected delivery of any message, for errors in message content, or for any action you take or fail to take in reliance on a message.

Changes. We may modify or cancel the Service or these SMS Terms at any time. Continued use of the Service after changes are posted means you accept them.

Privacy. How we collect and use your phone number and other personal information is described in our Privacy Policy.
